By using our website https://easyp.ch (our « Website »), the EasyP app (our « App ») and any associated services (collectively, the “EasyP Platform”) provided to you by us, you acknowledge that you have read and are bound by this Privacy Policy.

 

 

1. Who is the controller of your data ?

 

EasyP SA (“we”, “us” or “EasyP”), a Swiss public limited company registered under no. CHE-499.827.370, with its headquarters located at Avenue de Florimont 3, 1006 Lausanne, Switzerland, acts as the data controller of your personal data.

 

 

2. Which data do we process and how do we collect it ?

 

We process personal data you share with us or generate when using the EasyP Platform, including:

  • personal and contact details (e.g., title, full name, telephone number, email address, contact details history);
  • vehicle information (e.g, license plate, vehicle model);
  • geo-location data from your IP address or mobile device’s GPS;
  • records of your contact with us via telephone, our online services or our App (e.g., mobile phone location data, IP address and location);
  • details of products and services you use or are interested in, including payment methods;
  • usage data of our products and services, and details related to this;
  • marketing communications, including tracking engagement and analyzing data to tailor offers to you;
  • information from third parties;
  • property or possession information (e.g., parking space location, type, and availability);
  • data purchased or rented from third parties (e.g., demographic details, vehicle history, and marketing lists);
  • insights about you and our customers gained from analysis or profiling of customers;
  • third party transactions; such as where a person other than the account holder uses the service, information about that person and the transaction.

If you share personal data about other people with us (e.g. as part of our referral program or when giving us access to your contact list), you confirm that you have brought this notice to their attention beforehand.

  • open and manage your account and provide you with our products and services;

4. To whom do we transfer your data ?

  • users of the EasyP Platform (e.g., drivers and space providers);
  • third-parties involved in a service (e.g. counterparties, operators of payment transaction systems);
  • our service providers (e.g. IT, back-office and logistics service providers);
  • tax authorities, withholding agents, auditors, or other relevant third parties;
  • courts, authorities and self-regulatory bodies;
  • media outlets requesting comments from us; and/or;
  • other third parties with whom you allow us to share data.

 

 

5. Where do we process your data ?

 

As a Swiss company, we mainly process your data in Switzerland. When sharing data with the recipients listed under clause 4, we may transfer your data to other countries inside or outside of the Economic European Area, in particular in the United States of America, but potentially anywhere in the world. Where required by law, we put in place appropriate safeguards (such as standard contractual clauses recognized by the Swiss Federal Data Protection and Transparency Commissioner and by the European Commission) before transferring your personal data abroad. 

 

Once transferred outside of Switzerland, personal data is no longer protected by Swiss law but subject to the applicable legislation, and may be transmitted to third parties or authorities in accordance with such legislation.

 

6. For how long do we retain your data ?

 

We only keep your personal data for as long as is necessary in light of the purposes for which it is processed, subject to any legal, regulatory or contractual requirements, the time in which any litigations or investigations might arise and the need to answer queries or resolve issues. In general, we keep data for as long as you maintain an account with us and for ten years thereafter. When personal data is no longer required, we will delete it.

We use cookies and other similar technologies, such as web beacons, pixels, and mobile identifiers, to enhance your experience on the EasyP Platform. Some are strictly necessary for its functionality, while others improve performance.

 

Cookies help us: track website usage, remember your booking basket, monitor booking progress, simplify login, secure your session, offer live chat, improve user experience, personalize ads, send reminders, enable payments, and recognize your device for seamless navigation. We also analyze user behavior to improve our services.

8. What are your rights regarding your data ?

 

You are entitled to submit a request to us at the address set forth under clause 9, to:

  • request the completion or correction of your personal data that is incomplete or inaccurate;
  • restrict or object to the processing of your personal data;
  • erase your personal data;
  • receive, or request EasyP to transmit to another designated person or entity, your personal data that EasyP holds about you in a structured, commonly used and machine-readable format, and;
  • wherever processing of your personal data by EasyP is based on your consent, withdraw your consent to the processing of your personal data.

 

When you submit such a request, we may require that you provide information to confirm your identity.

 

The exercise of the above-mentioned rights (e.g. your objection to the processing of your personal data or withdrawal of any previously given consent) may prevent us from providing you with all or part of our services. If we consider that, by agreeing to your request, we would no longer be able to provide our services to you in a manner that fulfills our quality standards, we may decide to terminate your account with us.

 

The above-mentioned rights may also be limited – for example when we are required to obtain and process your personal data to comply with applicable law and regulation, to assert or defend against legal claims, or when we have other legitimate grounds for the processing that override your interests and rights. We may therefore be entitled to continue processing your personal data even after you have chosen to withdraw your consent or objected to the processing of your personal data.

 

If requests are manifestly unfounded or excessive, in particular because of their repetitive character, we reserve the right to either charge a reasonable fee taking into account the request or refuse to act on the request.

11. Applicable law and jurisdiction

 

This Privacy Policy is exclusively governed by Swiss law, without regard to conflict of laws provisions. The exclusive place of jurisdiction for any dispute arising out of or in connection with this Privacy Policy is where EasyP has its registered office, subject to an objection to the Federal Supreme Court. We however reserve the right to take legal action against you in a court of competent jurisdiction of your place of residence or before any other competent court or jurisdiction. In such cases too, Swiss law will apply exclusively.
